NOTICE: BY EXECUTING THIS AGREEMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS. PLEASE READ CAREFULLY.
This Waiver, Release, and Indemnification Agreement ("Agreement") is entered into by the undersigned Adult Participant on behalf of themselves and Other Participants, as defined herein, in favor of ClawZone Park.
1. NATURE OF ACTIVITIES
ClawZone Park operates an entertainment center featuring immersive Virtual Reality (VR) experiences, Human Claw Machine attractions, and other interactive exhibits.
1. TYPES OF RISKS
Participant acknowledges and assumes the inherent risks and potential injuries associated with participating in activities, including but not limited to:
- Equipment failure or malfunction
- Collisions or impacts
- Overexertion or physical strain
1. ASSUMPTION OF RISKS
Participant knowingly and voluntarily assumes all risks inherent with activities and access to premises, including those risks listed above.
1. ALCOHOL CONSUMPTION
Participant agrees to refrain from consuming alcohol to the extent that their judgment, decision-making, or physical abilities are impaired.
1. RELEASE AND INDEMNITY
To the fullest extent permitted by law, Adult Participant releases, covenants not to sue, and shall indemnify, defend, and hold harmless ClawZone Park from all claims, demands, or causes of action relating to property damage or bodily injury resulting from participation in activities.
1. DISPUTE RESOLUTION
Any dispute arising from this Agreement shall be resolved through binding arbitration administered by the American Arbitration Association.
1. LICENSE
Participant grants ClawZone Park the right to capture and utilize photographs and video footage for advertising, marketing, and promotional purposes.
1. AUTHORITY
If Adult Participant executes this Agreement on behalf of Other Participants, they warrant and represent having the legal authority to do so.
1. ACKNOWLEDGMENTS
Participant represents that this Agreement constitutes the entire understanding between the parties and supersedes all prior or contemporaneous agreements or representations.
1. REPRESENTATIONS BY PARTICIPANT
Participant represents that they will:
- Comply with all rules and regulations
- Possess sufficient skill and physical fitness to participate
- Cease participation if experiencing unusual discomfort or distress
